Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using UnMarkedAI (the "Service"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and UnMarkedAI Ltd ("UnMarkedAI", "we", "us", "our"), a company registered in the United Kingdom.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use after changes become effective constitutes acceptance of the revised Terms.

2. Eligibility

To use UnMarkedAI, you must:

• Be at least 13 years of age (or 16 years of age in the European Union, United Kingdom, or where required by local law).
• Have the legal capacity to enter into a binding contract in your jurisdiction.
• Not be prohibited from using the Service under applicable laws.
• Not have previously been suspended or banned from using our Service.

By using the Service, you represent and warrant that you meet all eligibility requirements. If you are using the Service on behalf of a business or organisation, you represent that you are authorised to accept these Terms on its behalf.

3. Accounts & Registration

To access most features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep it updated. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately at security@unmarkedai.com of any unauthorised access.

We reserve the right to refuse registration, cancel accounts, or remove content at our discretion. You may not share your account with others or create multiple accounts to circumvent usage limits.

4. Permitted Use

UnMarkedAI grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal business purposes, subject to these Terms.

Permitted uses include:

• Rewriting and improving AI-generated text for academic, personal, or professional writing.
• Reducing the likelihood of AI detection scores for content you have legally created or commissioned.
• Integrating with our API for your own legitimate applications, subject to our API Terms.

5. Prohibited Use

Violation of these prohibitions may result in immediate account termination, legal action, and/or reporting to relevant authorities. We cooperate fully with law enforcement requests.

6. Intellectual Property

6.1 Your Content

You retain all intellectual property rights in the content you submit to the Service ("Your Content"). By submitting content, you grant us a limited, worldwide, royalty-free licence to process and transform Your Content solely for the purpose of providing the Service to you. We do not claim ownership of Your Content.

You represent and warrant that you have all necessary rights to submit Your Content and that Your Content does not infringe any third-party intellectual property rights.

6.2 Our Intellectual Property

The Service, including its software, design, algorithms, user interface, logos, trademarks, and all related intellectual property, are owned by UnMarkedAI Ltd and protected by UK and international intellectual property laws. You may not copy, reproduce, modify, reverse-engineer, decompile, or create derivative works from any part of the Service.

6.3 Output Content

Subject to your compliance with these Terms, humanized output generated from Your Content belongs to you. We make no representations about the originality or copyright status of output content — you are solely responsible for reviewing outputs and ensuring their appropriate use.

7. Subscriptions & Payments

7.1 Plans & Pricing

We offer free and paid subscription plans. Paid features require a valid payment method. Current pricing is available at unmarkedai.com/pricing. We reserve the right to change pricing with 30 days' notice to existing subscribers.

7.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorise us to charge your payment method automatically at the start of each billing period via our payment processor, Stripe.

7.3 Trials

Unless explicitly stated on a promotional offer, paid subscriptions do not include a free trial. If we introduce a trial in the future, the specific terms will be presented during checkout or in the relevant offer details.

7.4 Cancellations & Refunds

You may manage or cancel your subscription at any time via our billing portal. Cancellation takes effect at the end of the current billing period - you will retain access until then. We do not offer refunds for partial billing periods, except where required by applicable law. If you believe you have been charged in error, contact billing@unmarkedai.com within 30 days.

8. Acceptable Use Policy

To maintain a reliable and fair service for all users, you agree to the following usage limits and conduct requirements:

• Do not attempt to circumvent usage limits through automated requests, bots, or multiple accounts.
• Do not attempt to probe, scan, or test the vulnerability of the Service or any related systems.
• Do not interfere with or disrupt the integrity or performance of the Service.
• Do not use the API in ways that exceed reasonable rate limits or cause undue burden on our infrastructure.
• Do not resell or sublicense access to the Service without our written permission.

9. Disclaimers & Warranties

In particular, we do not warrant that:

• Humanized content will pass any specific AI detection tool or score below any particular threshold.
• The Service will be uninterrupted, error-free, or free from viruses or other harmful components.
• Outputs will be accurate, complete, or suitable for any specific purpose.
• The Service will meet your specific academic institution's policies or requirements.

You are solely responsible for determining whether the use of AI-assisted writing complies with the rules of your academic institution, employer, or any other applicable policies.

10. Limitation of Liability

To the maximum extent permitted by applicable law, UnMarkedAI Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses arising out of or relating to your use or inability to use the Service.

Our total aggregate liability to you for any claims arising from or relating to these Terms or the Service shall not exceed the greater of (a) the total amount paid by you to us in the twelve (12) months preceding the claim, or (b) £100 GBP.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless UnMarkedAI Ltd, its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

12. Termination

Either party may terminate this agreement at any time. You may close your account via your account settings. We may suspend or terminate your access to the Service immediately, without notice, if we reasonably believe you have:

• Violated these Terms or our Acceptable Use Policy.
• Engaged in conduct harmful to other users, us, or third parties.
• Created legal risk or liability for UnMarkedAI.
• Failed to pay applicable fees.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer protection laws in your jurisdiction provide otherwise.

Before commencing formal proceedings, we encourage you to contact us at legal@unmarkedai.com to attempt to resolve disputes informally within 30 days.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and UnMarkedAI regarding the Service.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
• Waiver: Failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights to a successor in connection with a merger, acquisition, or sale of assets.
• Force Majeure: We shall not be liable for failure to perform due to causes beyond our reasonable control, including natural disasters, internet outages, or government action.
